- The Seller, owner of the Royal Eagle Road trademark, acts in the exercise of its commercial activity and promotes the sale of its products by entering into distance contracts through this website in compliance with the following General Sales Conditions.
- Consumer: the person who acts for purposes not related to the entrepreneurial, commercial, craft or professional activity;
- User: visitor of the platform that interacts with the website’s functions, the notion also includes the Consumer;
- Online Sales Contract: purchase contract related to the purchase of goods available on the website that is stipulated between the Seller and the Consumer;
- Parties: the Seller (International Mercury Srl) and the Consumer (User);
- Product: the goods on sale on the website that can be purchased through the stipulation of a distance contract;
- Website: royaleagleroad.com, managed by the Seller, where the online purchase contract is concluded.
2. GENERAL PROVISIONS
2.1 These Terms of Sale regulate the commercial relations between the Seller and the Consumer and constitute an integral and substantial part of the contract for the sale of goods that will be concluded. Different conditions dictated by the Consumer can never become part of the contract between the parties.
2.2 The Parties, in compliance with the mandatory rules of the law, agree that if some provisions of these Terms of Sale should be declared invalid, this fact will not affect the validity and effectiveness of the other provisions that will remain fully valid and effective.
3. MODIFICATIONS TO THE TERMS OF SALES
3.2 The Consumer will be subject to the policies and terms of the Terms of Sales effective at the moment when the Consumer places an order, unless any changes to these policies and to these terms are not required by applicable law or by the competent authorities.
4. CONCLUSION AND EFFECTIVENESS OF THE CONTRACT
4.1 The sales contract is concluded when the Consumer receives an email that confirms acceptance of the order from International Mercury Srl.
4.2 The email contains: order number, price of the goods purchased including VAT, shipping costs. The Consumer needs to verify that the information contained in the email are correct. In case of modifications, the Consumer has to promptly notify International Mercury Srl providing the order number though email to [email protected].
5. FEATURES, PRICES AND AVAILABILITY OF THE PRODUCTS
5.1 The User is aware that all the information provided on the website, and in particular, the images shown in the product page are made available for simple information purposes, in order to identify the article. Any image, dimension or color of the products offered for sale may not be perfectly representative of their real characteristics. Any discrepancy could be due to the monitor screen and its settings or to the result of the colors in the Internet browser. In the event that these discrepancies do not concern the essential characteristics of the products and their quality, the User will not be entitled to terminate the purchase contract.
5.2 The prices indicated for each product may be subject to updates and are valid until the date on which they will be modified online. The Seller reserves the right to update the prices at any moment and the User will view them by browsing the Site.
5.3 All sales prices indicated on the website www.royaleagleroad.com are indicated in Euros, inclusive of VAT and are offered to the public on the date on which the order is executed.
5.4 The prices indicated on the website do not include: shipping costs (except in Italy where shipping is free), duties, taxes imposed by other sovereign States, extra charges, etc. Products sold in Italy (excluding Livigno, Trepalle, Campioni d’Italia, Città del Vaticano and San Marino) and in the European Union are not subject to customs duties and taxes. Products delivered outside the European Union may be subject to customs duties and taxes which vary according to the country and the product purchased. These costs will be borne by the Consumer who can contact the competent authority of his/her country to quantify these customs costs.
5.5 In Italy the shipping is free. The prices of the products indicated on the website do not include shipping costs to other countries. These costs are indicated separately when the purchase order is made and are included in the total price shown in the order and in the confirmation e-mail sent by the Seller. For shipping to Livigno, Trepalle, Campioni d’Italia, Vatican City, San Marino, Italian Islands and Venice, please contact International Mercury Srl before placing the order.
5.6 In case that International Mercury Srl notices an error in the price of the products ordered or in the shipping costs, the Seller will immediately inform the Consumer. The Consumer can decide whether to confirm the order at the correct price or cancel it. In case of cancellation of the purchase order, which has to be in writing, International Mercury Srl will refund the amount paid.
5.7 In case the products are not available for purchase in that very moment, International Mercury Srl will notify the Consumer who has the right to:
- choose to wait for product availability,
- choose another product,
- delete the order.
In case of cancellation of the order, the Seller will refund the Customer with the same payment method used for the purchase.
6. SHIPPING AND DELIVERY TIME
6.1 Shipping costs are indicated during the purchase phase and in the final order summary. The costs vary depending on the destination and the quantity of the goods purchased. In Italy the shipping is free. The prices of the products indicated on the website do not include shipping costs to other countries. These costs are indicated separately when the purchase order is made and are included in the total price shown in the order and in the confirmation e-mail sent by the Seller. For shipping to Livigno, Trepalle, Campioni d’Italia, Vatican City, San Marino, Italian Islands and Venice, please contact International Mercury Srl before placing the order.
6.2 Orders are processed from Monday to Friday. The orders received on Saturday and Sunday will be processed the following Monday.
6.3 All products ordered by the Consumer and confirmed in writing by International Mercury Srl, will be sent by courier to the address indicated by the Consumer during the purchase phase. Products will be shipped only after payment of the order amount has been registered and confirmed to International Mercury Srl.
6.4 The Consumer is responsible for the accuracy of the shipping address. The communication of an incorrect address, not rectified in writing before the Consumer receives the confirmation of the acceptance of the order, may involve additional expenses from his part. Once the items have been shipped, it is no longer possible to change the destination address.
6.5 International Mercury Srl undertakes to do its utmost to deliver the products by the dates indicated in the relevant order acceptance. In Italy delivery is completed approximately in 4 – 6 working days. In European Union 5 – 7 working days. These dates have to be considered approximate, but not binding, unless International Mercury Srl has explicitly established a fixed delivery date with the Consumer.
6.6 When it is not possible to meet these deadlines, International Mercury Srl will inform the Consumer. Any delays in delivery of the goods do not entitle the Consumer to terminate the contract concluded.
6.7 If the Consumer does not receive the products within the indicated time, please contact International Mercury Srl at the e-mail address [email protected], or at the customer service at the number +393914695085 indicating the order number.
7. METHOD OF PAYMENT
7.1 The Consumer can use the following payment methods on the website www.royaleagleroad.com:

7.2 The items are reserved at the time of the order and will be shipped as soon as the payment is credited. If the Seller does not receive the payment within 5 working days, the order will be automatically canceled.
8. FORCE MAJEURE
9. RIGHT OF CANCELATION AND RETURN POLICIES
9.1 According to the art. 52 of the Consumer Code, the Consumer has the right to withdraw from the purchase contract without justifying the reasons and without any penalty, within a period of 14 (fourteen) days starting from the day of delivery of the ordered items.
9.2 In the case of multiple goods ordered by a single order and delivered separately, the deadline for exercising the right of withdrawal starts from the day on which the Consumer, or a third party designated by him/her, acquires physical possession of the last good.
9.3 The Consumer is only responsible for the decrease in the value of the goods resulting from the handling of the goods different from the one necessary to establish the nature, characteristics and functioning of the goods as defined in Article 57 of the Consumer Code.
9.4 The essential condition for exercising the right of withdrawal is the concrete integrity of the products returned. Items has to be returned intact, including labels, tags, in their original packaging, perfectly preserved, as delivered.
9.5 Items returned incomplete, damaged, used or stained due to reasons attributable to the Consumer will not be refunded and will not, in any case, give the right of a credit equal to the price of the ordered item. International Mercury Srl will inform the Consumer of the defects found on the products and the impossibility of accepting the return.
9.6 The Consumer has to explicitly declare that he wishes to exercise the right of withdrawal and indicate the order number, invoice number, code and quantity of the products, as well as if the withdrawal is partial (only in the case of the purchase of more than one item) or total. The communication has to be in writing by sending an email to the address [email protected].
9.7 The Consumer will choose a courier and will be responsible for the shipping costs for returning the goods.
The goods have to be sent to INTERNATIONAL MERCURY SRL Via Fratelli Rosselli 72, 67051 Avezzano (AQ), Italy.
9.8 International Mercury Srl will refund the due amount after having received the goods and checked them. The amount will be refunded with the same payment method that was made by the Consumer, unless the Consumer has otherwise agreed. All returned packages are the responsibility of the Consumer. International Mercury Srl is not responsible for lost items during return shipping.
9.9 The right of withdrawal is excluded in case of supply of tailor-made or personalized goods, pursuant to art. 59 lett. c) of the Consumer Code.
10. REPLACEMENT OF THE PRODUCTS
10.1 The Consumer, on delivery of the goods, is required to check that the products received comply with the order confirmation. Any product for which no dispute has been raised in accordance with the procedures and terms indicated above is considered approved and accepted by the Consumer.
10.2 In case the product is damaged or defective, the Consumer has to give detailed communication specifying the type and nature of the defect by email to the address [email protected] explaining the reason for returning the item and highlighting clearly what the defects are and / or where the damage is located. He/She will also have to provide photos to prove the defect, sending everything by e-mail to the address [email protected].
The Consumer has to communicate the defect within 3 (three) working days from the delivery of the products.
10.3 The Customer Assistance of International Mercury Srl will contact the Consumer to establish the methods for replacing the product. Complaints accepted by International Mercury Srl will give place to the replacement of the defective or non-conforming product, or its reimbursement in the event of unavailability of the product in stock.
10.4 The product that is damaged, defective or non-conforming to the order will be returned to International Mercury Srl according to the latter’s procedures agreed with the Consumer. Before replacing the product or refunding the amount, International Mercury Srl will inspect the product.
10.5 International Mercury Srl will bear the shipping costs for returning and replacing defective products in the manner it consider appropriate.
10.6 The Consumer is required to return damaged, defective or non-compliant to the order products including labels, tags and packaging, taking care to protect the content.
11. CONSUMER OBLIGATIONS
11.1. The Consumer undertakes to pay the price of the product purchased within the times and methods indicated in these General Conditions of Sale.
11.2. The Consumer has to read carefully the information contained in these Conditions of Sale and accept them during the purchase confirmation phase.
11.3 The Consumer undertakes to be present at the delivery time or to appoint a trusted person to receive the goods, within the period specified in the order and in the order confirmation.
11.4 At the time of delivery of the goods, the Consumer (or the person in charge of this) has to check the condition of the packaging, the number of packages and the goods in terms of quantity, codes, status and features.
12. RESPONSIBILITY AND LIMITATIONS OF LIABILITY
12.1 The information contained in this website is to be considered only of a generic nature and cannot be considered as a substitute for legal assistance, not even to exclude or limit the responsibilities provided for by law.
12.2 International Mercury Srl is not responsible to the Consumer for disruptions or malfunctions connected to the use of the Internet beyond its control, except in the case of fraud or serious negligence.
12.3. International Mercury Srl undertakes to provide clear indications on the correct use of the product through technical descriptions published on the website www.royaleagleroad.com. No compensation will be due if the Consumer uses the product incorrectly and / or improperly, neither in the case of continuous and prolonged use which leads to natural wear of the product.
12.4 International Mercury Srl is not responsible to the Consumer for the management of payments made through credit cards and other means of payment. The Seller entrusts specialized third parties to ensure that the payment transactions are carried out adequately protecting the Consumer’s information. International Mercury Srl will not be responsible for any damage suffered as a result of malfunctions connected to payment management services, or in the event of theft or unlawful access to Consumer data by third parties.

14.1 The User agrees to use the website www.royaleagleroad.com only complying with the applicable laws and these General Conditions of Sale. The User undertakes to refrain from any behavior contrary to the values of International Mercury Srl. In particular from:
– Obtaining and exploiting the personal data of users and the contents of the website for personal purposes;
– Obtaining and exploiting users’ personal data to publish third party identities;
– Publishing or spreading any type of content that could damage the rights of International Mercury Srl, both directly and indirectly;
– Spreading any false, illicit, prejudicial, offensive, discriminatory content that incites violence and hatred, contrary to morality, which damages private life and the rights of others, especially the rights to image, to intellectual property and respect for privacy;
– Committing illicit acts and from carrying out propaganda of any kind or nature.
14.2 The website is for users over the age of eighteen years and under-aged only if authorized by the parents. International Mercury Srl is not responsible for the use of the website by the under-aged and invites anyone with the responsibility of a minor to monitor the use of the website.

16.2 The User is authorized to electronically copy and print the contents of the Site only within the limits necessary to place an order.
16.3 The User is not allowed to use or reproduce the trademark, names and descriptions, as well as to modify, copy, distribute, reproduce, publish, download, send, transmit, sell or acquire the contents of the website in any form or by any means, either in full or in part, including damage to the Royal Eagle Road brand reputation. Any violation will be punished according to the applicable laws.
17. APPLICABLE LAW AND DISPUTE RESOLUTION
17.1 The contracts established by the Seller and the Consumer as well as these General Conditions of Sale are regulated and interpreted in accordance with the laws in force in the Italian Republic, with particular reference to the legislative decree 6 September 2005 n. 206, on the Consumer Code.
17.2 If the Consumer has not Italian nationality, Rome is the competent court and the contracts stipulated by the latter with the Seller has to be considered as governed by the 1980 Vienna Convention.
